These Terms and Conditions set out the basis on which Gardeners Silvertown provides gardening and related services to residential and commercial clients in its service area. By making a booking, accepting a quotation, or allowing our gardeners or contractors to begin work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree to any part of these terms, you should not use our services. You are advised to read this document carefully before confirming a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Company refers to Gardeners Silvertown, the gardening service provider supplying the services.

Client refers to the person, business, or organisation that requests or receives services from the Company.

Services refers to any gardening, garden maintenance, soft landscaping, lawn care, hedge cutting, pruning, planting, pressure washing, or related works carried out by the Company.

Premises refers to the garden, land, or property where the Services are to be provided.

Agreement refers to the binding contract between the Company and the Client comprising these Terms and Conditions, together with any written quotation or booking confirmation.

2. Scope of Services

The Company provides a range of gardening and garden maintenance services within its service area. The exact Services to be provided will be described in the quotation or booking confirmation. Any images, descriptions, or examples in advertising or promotional materials are for general guidance only and do not form part of the Agreement.

The Company reserves the right to refuse work that it reasonably considers unsafe, unlawful, or beyond its professional capabilities or equipment. Where possible, the Company will suggest an alternative solution or modified scope of Services.

3. Booking Process

3.1 Initial enquiry

The Client may request a quotation or provisional booking by contacting the Company and providing details of the Premises, access, and the Services required. The Company may request photographs, measurements, or a site visit to prepare an accurate quotation.

3.2 Quotations

Any quotation issued by the Company is an estimate based on the information available at the time. Quotations are normally valid for a limited period from the date of issue, as indicated on the quotation, after which the Company may revise pricing or availability.

3.3 Acceptance and confirmation

A booking is deemed confirmed when the Client expressly accepts the quotation or service proposal, verbally or in writing, and the Company acknowledges the booking. The Client is responsible for ensuring that all details in the confirmation, including dates, times, address, and the Services required, are correct.

3.4 Changes to bookings

Any changes to the scope of Services, appointment date or time, or access arrangements must be communicated to the Company as early as possible. The Company will use reasonable efforts to accommodate changes but cannot guarantee availability. Changes may affect the quoted price or time required to complete the work.

4. Access and Client Responsibilities

The Client must provide safe and reasonable access to the Premises on the agreed date and time. This includes ensuring that gates are unlocked, keys or access codes are available where necessary, and any parking restrictions or entry conditions are disclosed in advance.

The Client must ensure that the Premises are in a suitable condition for the Services to be carried out, including clearing excessive obstructions, hazardous materials, or pet waste that might interfere with the work or pose health and safety risks.

Where access is prevented or significantly delayed due to the Client’s actions or omissions, the Company may treat the visit as a late cancellation and may apply charges in accordance with the cancellation terms set out below.

5. Pricing and Payment Terms

5.1 Pricing

Prices are generally quoted either as a fixed price for a defined scope of work or as an hourly or daily rate plus materials. The quotation or booking confirmation will specify the basis on which the price is calculated. All prices are in pounds sterling and inclusive or exclusive of applicable taxes as stated in the quotation.

If, during the provision of the Services, it becomes apparent that additional work is necessary due to unforeseen conditions, incorrect information, or changes requested by the Client, the Company will inform the Client as soon as reasonably possible and agree revised pricing before continuing.

5.2 Payment methods

The Company accepts payment by commonly used methods as communicated at the time of booking or on the invoice. The Client is responsible for ensuring that cleared funds are available by the due date.

5.3 Payment due dates

Unless otherwise agreed in writing, payment for one-off Services is due immediately upon completion of the work. For larger projects or ongoing maintenance contracts, the Company may require deposits, staged payments, or payment in advance. Such arrangements will be confirmed in writing.

5.4 Late payment

If the Client fails to pay any sum by the due date, the Company may charge interest on the overdue amount and may suspend or cancel future bookings until all outstanding amounts have been settled. The Client will be liable for any reasonable costs of debt recovery incurred by the Company.

6. Cancellations, Rescheduling and No-Show

6.1 Client cancellations

If the Client wishes to cancel or reschedule a booking, the Client must provide as much notice as possible. The Company may apply a cancellation fee for bookings cancelled or rescheduled at short notice, to cover administrative costs and loss of reserved time.

The applicable notice periods and charges, where any, will be set out in the booking confirmation or subsequently communicated to the Client. As a general guide, cancellations made on the day of the appointment may be charged up to the full fee, at the Company’s discretion.

6.2 Company cancellations

In the unlikely event that the Company needs to cancel or significantly reschedule an appointment due to staff illness, vehicle breakdown, extreme weather, or other circumstances beyond its reasonable control, it will notify the Client as soon as practicable and offer an alternative date or time. The Company will not be liable for any losses resulting from such cancellations other than a refund of any payment already made for the affected appointment.

6.3 No access or no-show

If the Company attends the Premises at the agreed time but is unable to gain access or commence work due to reasons within the Client’s control, this may be treated as a cancellation on arrival and a call-out or cancellation fee may be charged.

7. Garden Waste and Environmental Regulations

7.1 Handling of green waste

The Company will usually collect and bag green garden waste such as grass cuttings, leaves, small branches, and plant trimmings generated in the course of the Services. The quotation will state whether removal of green waste from the Premises is included or whether it will remain on site, for example in a compost area, bin, or designated location.

If disposal of large volumes of waste, tree stumps, soil, rubble, or other heavy materials is required, additional charges may apply. Any such arrangements will be agreed with the Client in advance.

7.2 Compliance with waste laws

The Company complies with relevant environmental and waste disposal regulations when transporting and disposing of garden waste. The Client must not request or permit the Company to dispose of waste unlawfully, for example by fly-tipping or burning in prohibited areas.

7.3 Non-garden waste

Unless otherwise agreed, the Company is not responsible for the removal or disposal of non-garden waste such as household rubbish, building materials, or hazardous substances. If such items are encountered on site and prevent the work from being carried out safely, the Company may suspend or cancel the Services and may charge for time already spent on site.

8. Health, Safety and Site Conditions

The Company is committed to operating in a safe and responsible manner. The Client must inform the Company in advance of any known hazards at the Premises, such as unstable structures, concealed ponds, exposed cables, or aggressive animals.

Children, pets, and third parties should be kept away from the immediate working area and any machinery used during the Services. The Company may pause or decline to work if it considers that health and safety are compromised.

Extreme weather conditions such as heavy rain, storms, high winds, or freezing temperatures may affect the ability to work safely or effectively. The Company reserves the right to reschedule appointments where weather conditions are unsuitable for the planned Services.

9. Quality of Service and Complaints

The Company aims to perform the Services with reasonable care and skill, in accordance with good gardening practice and within the limitations of the agreed scope and budget.

If the Client is dissatisfied with any aspect of the Services, the Client should raise the issue with the Company as soon as possible, providing clear details and, where helpful, photographs. The Company will investigate and, where appropriate, may offer to rectify the problem, repeat the work, or provide a partial refund. Any remedy will take into account the nature of the work, seasonal growth, and the condition of the garden before the Services were provided.

10. Client Materials, Plants and Property

If the Client supplies plants, materials, ornaments, or equipment for use in the garden, the Client is responsible for ensuring that they are suitable and free from pests or disease. The Company accepts no liability for defects in items supplied by the Client.

While the Company takes reasonable care to avoid damage, gardening work can involve the use of tools, ladders, and machinery near existing structures and features. The Client should remove fragile items and valuables from the working area in advance. The Company will not be liable for minor or cosmetic damage that is reasonably incidental to the performance of the Services.

11. Liability and Limitations

Nothing in these Terms and Conditions is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

Subject to that, the Company will not be liable for any loss of profits, loss of business, loss of use, or any indirect or consequential loss arising from or in connection with the Services or these Terms and Conditions.

The Company’s total aggregate liability to the Client in connection with any single claim or series of related claims shall not exceed the total fees actually paid by the Client for the specific Services giving rise to the claim.

The Company cannot guarantee the survival, performance, or growth of any plants, turf, or trees, as these are influenced by factors beyond the Company’s control, including weather, soil conditions, pests, diseases, and the Client’s ongoing maintenance and watering regime.

12. Delays and Events Beyond Our Control

The Company will not be responsible for any delay or failure to perform its obligations where such delay or failure is due to events beyond its reasonable control. These events may include, but are not limited to, extreme weather, public transport disruption, fuel shortages, strikes, accidents, illness, equipment failure, or changes in law or regulations.

Where such an event occurs, the Company will inform the Client as soon as reasonably practicable and will take reasonable steps to minimise the impact and to reschedule the Services if appropriate.

13. Personal Data and Privacy

The Company collects and uses certain personal information about Clients, such as name, address, and contact details, for the purposes of managing bookings, providing the Services, processing payments, and complying with legal obligations.

The Company takes reasonable steps to protect Client information and will not sell or share personal data with unrelated third parties for marketing purposes without consent, except where required by law or necessary for the performance of the Services.

14. Termination

Either party may terminate an ongoing maintenance agreement or regular service arrangement by giving the other party reasonable notice, as specified in any separate agreement or service schedule. Termination does not affect the rights and obligations that have already accrued, including the Client’s obligation to pay for Services already performed.

The Company may terminate the Agreement with immediate effect if the Client persistently fails to pay on time, behaves in an abusive or threatening manner towards staff, breaches these Terms and Conditions in a serious way, or requests unlawful or unsafe practices.

15. Variations to These Terms

The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, business practices, or service offerings. The version in force at the time of the Client’s booking will apply to that booking. The Company may also agree specific variations or additional terms in writing for particular projects or contracts.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.

By proceeding with a booking or allowing our gardeners to commence work at your Premises, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
